## What it is

Elected bodies make the legislative land use decisions: city councils in cities, and county commissions or boards of supervisors in counties. Their vote usually follows a planning commission recommendation.

## What it tells you

Council approval is often the last public vote before a project moves to engineering, plats, and building permits. It's around this point that the developer picks much of the team.

## How it moves through a city or county

1. The planning commission's recommendation and the staff report go to the council.
2. The council holds a public hearing when one is required.
3. It approves, denies, changes, or sends the item back.
4. Approvals are adopted by ordinance or resolution, sometimes over two readings.

Some states and cities require a larger vote when the planning commission recommends denial or neighbors file a protest. Which items reach the council at all depends on the local code.

Rules vary by state, county, and city. These pages describe common practice, not legal advice.

## Common questions

### What is a second reading?

Many councils adopt an ordinance over two meetings: a first reading to introduce it and a second reading to adopt it. Some state laws or city charters require this; others allow a single vote.

### Can a city council overrule the planning commission?

Yes, in most places a city council can approve what the planning commission recommended denying, or the reverse. Some codes require a larger majority to do it.
